The Board of Zoning Appeals is a semi-judicial body established by communities which have a zoning ordinance. Members are appointed by the Mayor and City Council and serve a three-year term. This is the only board whose decision is binding. Any appeal of the decision made by this committee must be reviewed by the McPherson County District Court.
Duties of the Board are outlined in State Law and are centered on the following items:
a. Appeals regarding the application of the Zoning Ordinance.
b. Appeals based on applicants’ assumption that Zoning Administrator has made an error in judgment.
c. Variances from setback, side, front, rear yard, height and other lot regulations within Zoning Ordinance.
d. Grant exceptions to the use regulations of the Zoning Ordinance.
